Talking Wise EP5. “Five myths that trip up logistics companies”

Myth: “They are British, so I know they have the right-to-work”. Reality: Assumptions are just asking for a fast track visit from the Home Office. Documentation is non-negotiable, regardless of nationality.

Myth: “If we’ve got a contract, we’re safe.” Reality: There is a difference between having a piece of paper and actually following it. Both terms and on the ground working conditions change regularly a ‘set it and forget it’ mindset is a massive liability.

Myth: “Compliance slows growth.” Reality: It’s the lack of compliance that slows businesses down. Confident compliance is the engine for meaningful growth.

We’re joined by Gary Jacobs, founder of Gigzee and Eazitax. Gary brings decades of experience navigating the tax complexities of the private hire sector to show why “messy” management is a magnet for trouble from the Home Office and HMRC.

Gary breaks down the legal “litmus test” that determines whether your drivers are truly self-employed or if you’re sitting on a hidden employment liability:

What is self-employment? Gary explains that if a person is hired to complete a task without being told how, when, or where to do it, they are likely self-employed.

The importance of control – It’s all about the how, when, and where. If you dictate every movement, they might be an employee. If you hire them to complete a task and they choose the method, they are likely self-employed.

Financial risk – True self-employment means the individual carries the risk. If there’s no chance of them losing money on a bad job – or no opportunity to increase profit through efficiency – HMRC will have questions.

The right to substitute –  A cornerstone of self-employment. Can the person send someone else to do the job? If the contract requires their specific face and name only, the line between “contractor” and “employee” blurs.

There is a dangerous misconception that keeping “messy” records makes it harder for authorities to track you. Gary debunks this: disorganisation is not a shield. In fact, a lack of clear, professional records is often what triggers deeper investigations in the first place.
